Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of SetSides ("SetSides," "we," "us"), a service operated from Spain. By creating an account or otherwise using SetSides, you agree to be bound by these Terms. If you are using SetSides on behalf of a company, agency, or other organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of the service

SetSides is a script sides distribution and casting management platform for film and TV productions. It lets casting directors create productions, upload scripts, add and organise cast member records, share script pages with actors via expiring, watermarked links, track casting pipeline status, invite team members to collaborate on a production, and maintain a personal Talent Pool of actors across productions.

3. Account registration and responsibilities

To use most of SetSides, you need to create an account with a valid email address and password. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us immediately at info@setsides.app if you suspect unauthorised access to your account.

Actors who receive a share link do not need to create an account to view script sides or add annotations — Section 4 and our Privacy Policy explain what limited data is collected from that interaction.

4. Subscription plans, billing, and cancellation

SetSides currently offers the following plans:

• Free — no cost, limited to one active production at a time.
• Pro — billed monthly, annually (at a discount), or as a one-time per-production charge, removing the active-production limit and unlocking additional features.
• Agency — billed monthly or annually, built for teams and agencies managing multiple productions and collaborators.

Current pricing for each plan is shown on our pricing page and may change from time to time; we will give you reasonable notice before any price change affects your existing subscription. Paid subscriptions are billed in advance for the billing period you select (monthly or annual), except for the Pro per-production option, which is a one-time charge for that production. Payments are processed by Stripe; SetSides does not store your card details.

You may cancel a paid subscription at any time from your account settings. Your access to paid features continues until the end of the current billing period, after which your account automatically downgrades to the Free plan — your data is not deleted when you downgrade. We do not offer refunds for partial billing periods, except where required by law.

5. Free trial

Every new SetSides account starts with a 14-day free trial of the Pro plan. No credit card is required to start the trial. During the trial, you have full access to Pro features. When the trial ends, if you have not subscribed to a paid plan, your account automatically continues on the Free plan — your existing data (productions, cast records, scripts, etc.) remains intact, though access to Pro-only features and beyond-the-limit productions may be restricted until you subscribe. We reserve the right to change the length or terms of the free trial for future accounts at our discretion.

6. Acceptable use

SetSides is built for legitimate casting and production workflows. You agree not to use SetSides to:

• Upload or distribute scripts, images, or other content you do not have the rights to distribute;
• Harass, stalk, defame, or otherwise target any individual, including cast members or actors;
• Collect or store personal data about any individual without an appropriate lawful basis to do so;
• Attempt to circumvent share link expiration, watermarking, or access controls;
• Interfere with or disrupt the integrity or performance of SetSides or its infrastructure; or
• Use SetSides for any unlawful purpose, or in violation of any applicable law or regulation.

We may suspend or terminate accounts that violate this policy, as described in Section 10.

7. User-generated content and data responsibility

As a casting director, you are solely responsible for the accuracy of the information you enter into SetSides about cast members, Talent Pool actors, and productions, and for ensuring that you have a lawful basis to collect and hold that information — including, where relevant, information about minors (see our Privacy Policy for more on this). As explained there, you act as the data controller for that information, and SetSides acts only as a processor storing it on your behalf. You agree to indemnify and hold SetSides harmless from any claim arising from your collection or use of data about third parties through the platform in violation of applicable law.

8. Intellectual property

SetSides — including its software, design, branding, and underlying technology — is owned by SetSides and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets beyond what is needed to use the service as intended.

You retain all ownership rights to the content you upload to SetSides (scripts, photos, moodboards, and other materials). By uploading content, you grant SetSides a limited, non-exclusive licence to host, store, process, and display that content solely for the purpose of providing the service to you and the recipients you choose to share it with.

9. Service availability and limitation of liability

SetSides is provided "as is" and "as available." We do not guarantee any specific level of uptime for the Free plan. For paid plans, we make reasonable efforts to keep the service available and performant, but we do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by applicable law, SetSides and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim arising from these Terms or your use of SetSides is limited to the amount you paid us in the three months preceding the claim.

10. Termination

You may stop using SetSides and delete your account at any time from your account settings, or by contacting info@setsides.app.

We may suspend or terminate your account if you breach these Terms — including the Acceptable Use section — or if required to do so by law. Where reasonably possible, we will give you notice and an opportunity to resolve the issue before termination. Upon termination, your right to use SetSides ends immediately, and your data will be handled in accordance with our Privacy Policy.

11. Governing law

These Terms are governed by the laws of Spain, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of SetSides will be subject to the exclusive jurisdiction of the courts of Spain, unless applicable consumer protection law grants you the right to bring a claim in your own jurisdiction.

12. Changes to these terms

We may update these Terms from time to time as SetSides evolves. We will update the "Last updated" date at the top of this page when we do, and for material changes we will make a reasonable effort to notify active account holders (for example, by email). Continued use of SetSides after a change takes effect constitutes acceptance of the updated Terms.
